The reseller bill is the one that touches your tri-merge

H.R. 8141 would put the bureaus' accuracy duty on the company that assembles your tri-merge. It has cleared committee, not the floor. If it passes, the wrong address that kills a lock becomes the reseller's problem too. What to do now: nothing, except read the report you already order.

The reseller bill is the one that touches your tri-merge

Verdict: nothing changes on your desk this month, and one thing may change next year. Read the rest for the one thing.

H.R. 8141 cleared Financial Services on 1 September. It would add § 1681e(f): before a reseller transmits consumer-report information to an end user or another reseller, it must follow reasonable procedures to assure maximum possible accuracy. Two sponsors on each side, a committee amendment, no floor vote yet. Bills die here often. Calvin has the status and the reason the "delete anything" post that carried it is noise.

Here is why it is not noise for you. The tri-merge on your screen is not a bureau product. A reseller pulls three files and stitches them into one report, and the stitching is where the undisclosed address, the merged alias and the doubled tradeline are born. Today § 1681e(b)'s accuracy duty stops at the bureau; the reseller passes through what it got. Under 8141 the reseller owns accuracy too, with a safe harbor if it accurately relays what a bureau sent. Which means the reseller's own merge logic is exposed, and the reseller's dispute channel, which most of your borrowers have never heard of, becomes a place a dispute has teeth.

Three consequences if it passes. Borrower disputes will start arriving at the reseller as well as the bureaus, and your vendor will need a process you can point to. Conditions born of a bad merge will be easier to clear from your side, because the vendor will have a statutory reason to fix its own report rather than tell you to wait thirty days on Experian. And the rescore vendors will price for the new liability, so ask now what the file fee does if the bill moves.

What to do this quarter: nothing new. Order the tri-merge the way you already do, read page one before the scores, and send the borrower with a merge problem to the bureaus first, since that is where the fix still lives. When the bill passes, if it does, I will write the one-line change to your process. Danny says the same thing about a recall notice: do not replace the unit for a letter about a part that has not shipped.

One action, one number: pull your reseller's dispute-handling page today and file it. It's the page that goes from optional to required the day 8141 does.
